Expedition Terms & Conditions

1. Your Contract and Expedition Information

1.1 Frontier Offroad operates guided off-road motorcycle expeditions through remote areas of Mongolia. In these Terms, “Frontier”, “we”, “us” and “our” mean Frontier Offroad Lda. “Rider”, “Traveller”, “Participant”, “Client” and “you” mean the person booking or taking part in an expedition.

1.2 Your contract consists of these Terms, your booking confirmation, the Expedition Information for your departure, the applicable statutory package-travel information, any motorcycle damage terms, and any other document expressly incorporated into your booking. Mandatory law prevails over any inconsistent contractual term.

1.3 Before booking, the Expedition Information will identify the dates, duration, itinerary, approximate and minimum group size, price, accommodation, included meals, motorcycle, support arrangements, transfers, activities, exclusions, required riding level, licence requirements, insurance requirements and any departure-specific conditions.

2. Booking and Payment

2.1 An expression of interest does not secure a place. A booking is confirmed only when Frontier accepts the booking and receives the required deposit.

2.2 A deposit equal to 25% of the total expedition price is payable immediately upon booking. Subject to applicable law, this deposit is non-refundable.

2.3 The remaining 75% balance must be received no later than 12 weeks before the scheduled expedition start date.

2.4 Where Frontier accepts a booking 12 weeks or less before departure, the full expedition price is payable immediately upon booking.

2.5 If a payment is late, Frontier may issue a reminder and a reasonable final deadline. If payment remains outstanding, Frontier may treat the booking as cancelled by the Traveller, subject to applicable law and Section 5.

2.6 Unless Frontier agrees otherwise in writing, all expedition payments must be made in Euros (€). Bank fees, transfer charges and currency-conversion costs are payable by the Traveller.

2.7 Payment details will be provided with the booking invoice. Payments must be made only through Frontier-approved payment channels.

3. Price Changes

3.1 After a booking is confirmed, Frontier may increase the expedition price only where permitted by applicable law and only as a direct result of changes in fuel or energy costs, taxes or fees imposed by third parties, or relevant exchange rates.

3.2 Any permitted increase will be communicated clearly, with the reason and calculation, on a durable medium and no later than 20 days before departure. If the relevant costs decrease, the Traveller is entitled to a corresponding price reduction, less any actual administrative costs permitted by law.

3.3 Where a permitted price increase exceeds 8% of the total expedition price, the Traveller will receive the choices required by applicable law, which may include accepting the increase or terminating without a cancellation charge.

4. What Is Included and Excluded

4.1 Only services stated in the Expedition Information are included. Depending on the departure, these may include the expedition motorcycle, guides, support vehicle, mechanical support, expedition fuel, specified accommodation and meals, listed transfers and activities, luggage transport during the riding portion and expedition logistics.

4.2 Unless expressly included, the price excludes international flights, passports and visas, insurance, alcohol, personal riding equipment, optional activities, personal purchases, excess baggage and airline charges, accommodation or meals outside the itinerary, medical expenses, costs caused by leaving early and other personal expenses.

5. Cancellation by the Traveller

5.1 Cancellations must be notified to Frontier in writing. A cancellation takes effect when Frontier receives the notice.

5.2 A 25% deposit is required to secure a place on a Frontier expedition. Subject to applicable law, this deposit is non-refundable.

5.3 Cancellations received more than 12 weeks before departure will result in Frontier retaining the 25% deposit. Any amount paid in excess of the required deposit will be refunded, subject to applicable law.

5.4 Cancellations received 12 weeks or less, but more than 8 weeks, before departure will receive a refund equal to 50% of the total expedition price.

5.5 Cancellations received 8 weeks or less before departure will not be eligible for a refund. Subject to applicable law, the same applies where a Traveller fails to attend the expedition or does not arrive for departure.

5.6 Frontier's cancellation terms apply where a Rider is unable to travel because of personal circumstances, including illness, injury, family circumstances, work commitments or other personal reasons, subject always to any mandatory rights available under applicable law.

5.7 Nothing in this Section affects any mandatory rights available to you under applicable law. This includes, where applicable, statutory rights relating to unavoidable and extraordinary circumstances occurring at or affecting the destination, or transport to the destination, which significantly affect the performance of the expedition.

5.8 The cancellation terms above apply subject to any mandatory rights or limitations under applicable law. Where required by law, Frontier will take into account non-recoverable costs, cost savings and income obtained by reallocating the place, and will justify the cancellation charge on request.

5.9 Any refund legally due will be returned using the original payment method where reasonably possible and within the period required by applicable law.

6. Transfer to Another Traveller

6.1 Riders may transfer their place to another Rider, subject to the replacement Rider satisfying Frontier's reasonable expedition requirements, including applicable riding experience, licence, insurance, fitness and participation requirements.

6.2 The original and replacement Rider may be responsible for any outstanding balance and any reasonable additional costs actually incurred by Frontier in arranging the transfer, to the extent permitted by applicable law.

6.3 Nothing in this Section limits any statutory right to transfer a package booking under applicable package-travel law. Where Portuguese law applies, notice received at least seven days before departure is considered sufficient for the purposes of any applicable statutory transfer right.

7. Minimum Numbers and Cancellation by Frontier

7.1 Any minimum participant requirement will be disclosed before booking. Frontier may cancel if that minimum is not reached or if unavoidable and extraordinary circumstances prevent performance, subject to applicable law.

7.2 Where Portuguese package-travel law applies to an expedition lasting more than six days, cancellation for insufficient numbers will be notified no later than 20 days before departure.

7.3 If Frontier cancels, payments will be refunded in full within the legally required period unless the Traveller expressly accepts an alternative departure or credit. Where Portuguese package-travel law applies, the refund period is no more than 14 days after termination.

8. Passports, Licences, Experience and Insurance

8.1 You are responsible for holding a valid passport, satisfying the immigration and entry requirements applicable to you, and obtaining any required visa, motorcycle licence or International Driving Permit. Frontier may provide general information but does not decide whether you are legally entitled to enter Mongolia or ride there.

8.2 Frontier expeditions are not beginner motorcycle courses. You must meet the published experience level and be physically and medically capable of participating. Frontier may reasonably request evidence of experience, licence, fitness, relevant medical information or medical clearance where necessary for safety and emergency planning.

8.3 Every Rider must hold insurance meeting Frontier's mandatory expedition insurance requirements, including appropriate medical treatment, emergency evacuation and repatriation cover and, where required, cover for off-road motorcycle riding in Mongolia on the applicable motorcycle capacity. Frontier may require evidence before departure.

8.4 In addition, Frontier strongly recommends that Riders obtain comprehensive trip-cancellation cover at the time of booking.

8.5 Depending on the terms of your insurance policy, cancellation because of illness, injury, family circumstances, work commitments or other personal circumstances may be covered by your travel insurer. Insurance coverage varies between providers and policies, and Frontier cannot guarantee that any particular cancellation or loss will be covered.

8.6 Frontier is not responsible for losses caused by a Traveller being refused entry, failing to obtain required documentation or holding insurance that does not cover the expedition activity, except where responsibility cannot lawfully be excluded.

9. Motorcycles, Equipment and Damage

9.1 Frontier will use reasonable efforts to provide the model or category stated in the Expedition Information but may substitute a reasonably comparable motorcycle because of damage, mechanical issues, availability or circumstances beyond its reasonable control.

9.2 Frontier may require a refundable motorcycle security deposit and may offer an optional damage protection arrangement. The amount, deductible, coverage, exclusions and conditions will be disclosed before booking where applicable.

9.3 Normal mechanical wear is Frontier's responsibility. To the extent permitted by law and the disclosed damage policy, a Rider may be responsible for damage or loss caused intentionally, recklessly, negligently, through stunts or misuse, or by conduct materially contrary to safety instructions.

9.4 A motorcycle and any supplied riding gear, navigation equipment, camping equipment or other property remain under the Rider's reasonable care until returned. Traffic offences, fines, penalties and similar costs caused by the Rider are the Rider's responsibility.

10. Safety, Guide Authority and Conduct

10.1 The Expedition Leader has operational authority. Riders must follow reasonable instructions, ride within their capability and must not start, move or operate a motorcycle except as authorised.

10.2 Riders must not operate a motorcycle while impaired by alcohol, recreational drugs, medication or another substance that may affect safe riding. Riders must not leave the group, depart from the route or ride independently without guide approval.

10.3 For safety, Frontier may require a Rider to reduce speed, change position or route, use a support vehicle, stop riding temporarily or cease riding. Serious or repeated disregard of instructions, harassment, threatening behaviour, dangerous conduct or material disruption may result in partial or complete removal from the expedition, subject to applicable law.

11. Adventure Travel, Remote Conditions and Risk

11.1 Off-road motorcycling involves inherent risk, including falls, collision, loss of control, unstable ground, sand, rock, mud, ruts, steep terrain, water crossings, mechanical failure, animals, other road users, fatigue, dehydration, altitude, changing weather, serious injury and death.

11.2 Parts of the route may be far from hospitals, paved roads and emergency services. Treatment or evacuation may take materially longer than in an urban area. By participating, you acknowledge these characteristics but do not waive liability or statutory rights that cannot lawfully be excluded.

12. Routes, Accommodation and Operational Changes

12.1 The published itinerary is the intended plan, not a guarantee that every route, distance, stop, property, activity, timing or sequence will remain unchanged. Frontier may make reasonable adjustments for weather, terrain, flooding, safety, mechanical issues, supplier or accommodation availability, local restrictions, government action or other operational circumstances.

12.2 Remote accommodation may include hotels, lodges, tourist camps, ger camps and expedition-style facilities, with standards different from major international cities. Frontier will endeavour to use a reasonably equivalent substitute where necessary.

12.3 If a change before departure significantly alters an essential characteristic of a package, Frontier will provide the choices required by applicable law. If a material contracted service cannot be provided after departure, Frontier will take the steps required by law, including appropriate alternatives where possible. Ordinary safety and day-to-day route adjustments are not necessarily a lack of conformity.

13. Late Arrival, Early Departure and Participant Costs

13.1 Frontier is not required to provide a refund, replacement departure or equivalent service where a Traveller fails to arrive at the agreed meeting location on time, subject to applicable law. If Frontier can assist a late Traveller in joining the expedition, the Traveller may be charged the resulting transport and logistical costs.

13.2 Where permitted by law, a Traveller is responsible for reasonable additional costs caused directly by voluntary decisions or misconduct, including voluntarily leaving early, requesting additional accommodation or transport, intentional or reckless damage, or being removed for safety or conduct reasons. This does not shift costs for which Frontier is legally responsible.

14. Accidents and Emergencies

14.1 If a Participant is injured or becomes ill, Frontier will take reasonable steps appropriate to the circumstances, which may include first response, contacting medical services, the insurer or emergency contact, assisting with evacuation and modifying the expedition.

14.2 Emergency response in remote Mongolia may be delayed. Costs are allocated under the Traveller's insurance, the contract and applicable law.

15. Personal Property, Photography and Privacy

15.1 Travellers are responsible for taking reasonable care of their own baggage, equipment and valuables. Frontier's liability for lost, stolen or damaged property remains subject to applicable law.

15.2 Frontier may photograph or film expeditions. Where consent is required for identifiable commercial advertising or promotion beyond incidental documentation, Frontier will obtain it. A Traveller's own filming must not create a safety risk or unreasonably interfere with others. Organised commercial productions require prior approval.

15.3 Frontier will process personal information under applicable privacy law and its Privacy Policy. Information may be shared where reasonably necessary with suppliers, guides, insurers, medical providers or authorities to deliver the expedition, arrange services, manage safety or emergencies, comply with law or protect vital interests.

16. Responsibility, Suppliers and Complaints

16.1 Frontier will perform its obligations with the care required by law and, where it is the package organiser, remains responsible to the extent required by package-travel and consumer legislation even when using local accommodation, transport, guides, mechanics or other suppliers.

16.2 Nothing in these Terms excludes or limits liability where prohibited, including liability that cannot lawfully be waived for death or personal injury. Acknowledging inherent risk does not waive claims arising from Frontier's legally actionable acts or omissions.

16.3 If you believe a contracted service is not being provided properly, notify the Expedition Leader or Frontier as soon as reasonably possible so the issue can be investigated and, where required, remedied. Notification does not affect rights that cannot lawfully be waived.

17. Unavoidable and Extraordinary Circumstances

17.1 Events outside Frontier's reasonable control may include severe weather, natural disaster, wildfire, flooding, epidemic or pandemic restrictions, war or serious civil unrest, government action, border closure or serious security incidents.

17.2 The parties' rights, including statutory termination, refund and assistance rights, are governed by applicable law and these Terms. Frontier may offer an alternative departure or credit, but acceptance is voluntary where the Traveller is legally entitled to a refund.

18. Governing Law, Disputes and Package Travel Rights

18.1 These Terms are governed by the laws of Portugal, without depriving a consumer of mandatory protections available under applicable law. Disputes are subject to the competent courts and any legally required alternative dispute-resolution mechanism.

18.2 Where an expedition constitutes a package, all mandatory package-travel rights apply, including the Portuguese legislation implementing Directive (EU) 2015/2302. Frontier will provide the prescribed standard information form before the Traveller is bound where required.

19. Updates and Acceptance

19.1 The version supplied during booking governs that booking. Frontier may update these Terms for future bookings but will not materially alter an existing booking without the Traveller's agreement except where permitted by the contract and applicable law.

19.2 By completing the booking process, the Traveller confirms that they have received and read these Terms and the applicable Expedition Information, understand the physical and remote nature of the expedition, meet or will meet the participation requirements, will obtain the required insurance and agree to follow reasonable safety instructions.
